It is agreed between Buyer, and Midland Services, Inc. of Ashland Wisconsin, Seller, as follows:

1. The Buyer agrees to purchase the stated amount of gallons of propane for delivery between the date of signature and May 31, 2011.
2. 3. Any product purchased and delivered to the buyer over the contracted amount will be billed and paid for at the Seller's posted retail price on the date of delivery.
4. Any gallonage not used during the contract period will be forfeited at the cap price. After May 31, 2011, the unused payment for these gallons may be rolled into a future contract or be used as a credit on Accounts Receivable.
5. Buyer agrees that this contract does not guarantee supply of product. In the event there is a lack of supply caused by transportation, quotas set by the government agencies or actions of foreign or local governments and associations, or other such cause of shortage, Buyer agrees not to hold Seller responsible therefore.
6. Agreement and understanding of this contract is evidenced by signature. Contract prices vary.
   With the volatility of propane markets, this above stated contract price per gallon is only valid for 10 days from date of this document. Please return promptly and include full payment with the contract.

    SCHEDULED DELIVERY - I understand Midland Services, Inc will fill my tank as necessary based on my past usage pattern and weather conditions without my calling for deliveries. I will notify Midland Services of any abnormal conditions that might change my fuel consumption that could result in an outage for which Midland Services would not be responsible. (Alternate heat sources such as wood or electric could make it impossible to provide scheduled delivery services.)
